MealEasy respects your privacy. This Privacy Policy describes how we collect, use and disclose personal information. MealEasy recognizes the importance of obtaining consent where required by law for collection, use and disclosure of personal information. MealEasy intends to comply fully with Canada’s Personal Information Protection and Electronic Documents Act, commonly known as “PIPEDA”. This Privacy Policy does not govern personal information about our employees, which is addressed by other internal MealEasy policies. This Privacy Policy also intends to comply fully with the General Data Protection Regulation (GDPR) for individuals within the European Union where applicable.

What Constitutes Personal Information?

Personal information is any information about an identifiable individual, but does not include certain business contact information including the name, title, business address or business telephone number of an employee of any organization.

In order to use our Service or communicate with us we may collect the following personal information about you that you explicitly provide directly to us:

  12. Newsletter subscription status (sign up activation or deactivation, name and email address)
  13. Email or chat request content
  14. Other information as required or permitted by law.

We also may collect the following information indirectly or automatically when using our Service or visiting our site:

  4. If you subscribe to MealEasy by referral from a professional health practitioner site (a “Practitioner Referred Subscription” or “PRS”), the name and contact information of the relevant practitioner and the type of practice.
  5. If you subscribe to MealEasy by referral from a third-party organization who licenses MealEasy (a “Licensee Referred Subscription” or “LRS”), an assigned username, password and the name and contact information of the relevant Licensee.
  6. Information Collected by Cookies and Other Tracking Technologies. Our Service and our service providers collect information using various technologies, including cookies and pixel tags (sometime referred to as pixels, clear GIFs or web beacons). Cookies are commonly required to be used by web services to facilitate operation and are small data files that get stored on your hard drive or device memory. Cookies help us improve our Service, your experience using our Service, and track usage of our Service. Pixel tags are digital images that may be used by our Service or emails, and track the usage of our Service and help us monitor the effectiveness of our communications.

The information above is generally collected from you, but we may also collect information as necessary from financial institutions and credit card companies for the purposes of processing your payments for our products and services.

Use of Personal Information

Your personal information may be used by us as permitted or required by law and for the following purposes:

  1. to provide our products and services to you;
  2. to personalize the Service to you, for example to use your meal preference to help suggest suitable meals to you when using our Service;
  3. to process invoices and your payment by credit card or any other billing options which we may make available;
  4. to communicate with you regarding your Service account with us including responding to your inquiries, customer follow up, providing relevant subscription information to you, to seek your input and to advise you about products and services of Noviden and MealEasy and affiliated companies, to conduct online surveys, and optionally to deliver newsletter information to you, but only your name, email, address and telephone number will be used for this purpose;
  5. if yours is a PRS, to provide to the relevant professional health practitioner (the “Practitioner”), until such time, if any, as you revoke access to the Practitioner, which you can do at any time by using the “My Account” section of the MealEasy.com website, your meal plans (including the ability to view and alter the meal plan), grocery list and/or meal plan preferences (such as the diet type, foods restrictions and calorie requirements), but excluding your “My Account” details. Once provided to the Practitioner, (i) this information can be used by the Practitioner in the course of providing professional services to you, as consented to from time to time by you as part of the professional relationship between you and the subscriber, and as such will no longer be subject to our control and will no longer be governed by this Privacy Policy; and (ii) MealEasy will not have any liability or responsibility to you in respect of the information disclosed to and thus under the control of the Practitioner;
  6. if yours is a LRS, the Licensee provider manages access to our system for your account. We provide a mechanism for Licensee to do so securely, including setting your login credentials (username/email, and password) and granting or revoking access;
  7. to analyze or monitor usage, trends and activities in connection with our Service;
  8. to perform administrative tasks, including accounting and manage or enforce legal claims; and
  9. to help prevent, detect and investigate fraudulent transactions, abuse of our Service and other illegal activities and to enforce compliance with our policies and to comply with applicable law and government requests.

Sharing Your Personal Information

We do not sell your personal information to third parties. We may share some or all of your personal information as required or permitted by law, as follows:

  1. to third party service providers and hosting partners who assist us with operating our Service and who provide the necessary hardware, software, networking, storage and related technology. Your personal information shall only be provided to such third parties to the extent required for us to provide the Service, and such third parties shall be bound by obligations of confidentiality and shall not be permitted to use your personal information for any purposes beyond the scope of providing their services to us to support MealEasy, without your additional consent;

  4. to another company or business, in the event of a proposed transfer or actual transfer of ownership of all or part of our company to that other company or business, but for this purpose, we shall not authorize use of your personal information beyond the scope of any such transaction or this Privacy Policy;
  5. if yours is a PRS, to the relevant Practitioner as described earlier in this Privacy Policy;
  6. if yours is a LRS, to the relevant Licensee as described earlier in the Privacy Policy; and
  7. with your permission, we may allow others to use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Service as stated in our Cookies section below.

Aggregate Information

We may use aggregate information about our customers, without identifying such customers, for the purpose of research, improving our site, and reporting on trends and patterns of our customers and the use of the MealEasy Service.

The security of your personal information is important to us, and we use various technical, contractual, administrative and physical security measures to protect personal information that you provide to us. We instruct our employees to comply with privacy laws and with this Privacy Policy. Personal information for our accounts is kept for 6 years after the account is inactive, in accordance with Canadian Tax Laws.

Access, Modification or Deletion of Personal Information

At any time you may contact us using the Contact Us information provide below to request a copy of the personal information we currently maintain regarding your Service account. You may also request modification to your personal information by contacting us, or by using the My Account section of our Service. To request deletion of your personal information you may also contact us to facilitate this request. Please note that records of financial transactions including purchases you may have made with respect to our Service are retained for 6 years, as required by Canadian Tax Laws.
